Which Form Of Bankruptcy Is Right For You?

The recent economic downturn has caused debt problems even for people who thought they were doing everything right. Unfortunately, no matter how much you prepare, some things are unavoidable. Most consumers file for one of two types of bankruptcy:

  • Chapter 7 Bankruptcy: With Chapter 7 bankruptcy, all of your eligible debts are wiped away in one clean sweep. However, you may have to sell off some of your assets (most Chapter 7 filers do not have to sell any assets). Chapter 7 is also called a “fresh start” or “liquidation” bankruptcy. Student loan debt, back child and spousal support payments, and certain taxes are not eligible to be discharged under Chapter 7.
  • Chapter 13 Bankruptcy: With Chapter 13 bankruptcy, all of your debts are consolidated into one manageable monthly payment. After making this payment consistently for three to five years, any debt that remains is completely discharged. Also called a “wage earner’s” bankruptcy, Chapter 13 can often be used to stop foreclosure and repossession.

You Can Gain Immediate Relief Through Bankruptcy

The instant you file for bankruptcy, the bankruptcy court orders your creditors to stop making any attempts to collect money from you. No more harassing phone calls, no more past due notices in the mail. If your wages are being garnished, the garnishment will stop. Learn more about stopping creditor harassment and garnishment.
